I know from experience: I’m searching for an apartment in Nashville, Tennessee, as I write this. It’ll be a home base when my husband has to work in person at his new job. We’ll keep our home in Louisville, but I plan to spend some time there as well, which means our two dogs will be with us. (Truffle is a senior Pomeranian, and Cash is a 95-pound Great Pyrenees/German shepherd.) Suddenly, our options are dramatically limited. The one apartment we found in our price range allows a max of 100 pounds combined for two dogs, so that’s out. And if we can find a place, the costs — in an already eye-poppingly expensive city — will jump even higher, thanks to “pet rent” and extra deposits or fees.

The difficulty that often arises for OMCs is when tenants/owners do not comply with such requests and it is then a matter for the OMC to decide whether or not to take legal proceedings to enforce the lease covenants to which the apartment owner signed up to. However, unless the OMC has a legal fund to cover such expenses most will not seek to incur the costs (and time) associated with this course of action.

Exercising proper control

Under the Control of Dogs Act, it is the person who owns the dog who is responsible for its behaviour and is responsible for exercising proper control of their pet. In the event that someone is injured by a dog within the complex it is therefore the dog owner who is liable.

The issue of dog fouling, however, is much more of a grey area as local authority by-laws do not cover private property. The OMC relies heavily on its pet-owning residents to behave responsibly and pick up after their pets.

If the OMC believes that it needs to amend its house rules to be more explicit about the prohibition of dogs from the complex, it may propose such amendments for consideration at a meeting of its members.

Typically this would be done as a special resolution at the annual general meeting and requires the approval of at least a minimum 75 per cent of members in attendance (in person or by proxy) and eligible to vote in order to approve.

In any event, it may be time for the OMC to remind its members and residents of their responsibilities when it comes to the complex so as to ensure that all residents can enjoy living within it.

Houzzers love their pets as much as — and sometimes more — than their houses. Pet guardians often treat their dogs as part of the family; for many people, dogs are truly man's best friend.

But not all homes welcome pooches and other pets, and hosts can be put in a difficult position when someone brings a dog to a party or arrives unannounced with a fur ball tucked inside a purse. Some people can't risk infection from animals; some have furniture that's too delicate for a rambunctious, chew-happy creature. There are allergies to take into consideration, or perhaps there's another animal in the house that turns aggressive or fearful around outside pets.

Whatever the reason, the Emily Post Institute's position is clear on the "no dogs allowed" rule: You should always be up-front with your guests before they arrive. However, if you're caught off guard by a furry visitor on your doorstep, know that there are ways to honor your home and those in it without offending your guest and their four-legged friend.

Allow some exploring. Dogs are territorial and will want to explore the new terrain that is your house. Let them. The sooner they sniff out every nook and cranny, the sooner they'll calm down and feel comfortable in their surroundings.

Provide outdoor access. Unless your four-legged guest is a lethargic dog like an English bulldog or an easily winded pug, he or she may prefer to stay outside, especially if it's cooler or more breezy than the interior.

Be prepared for some digging around a few hedges and bushes — it's just dirt. But if the dog leaves a smelly gift, it's perfectly fine to ask the guardian to scoop up the poop in a plastic bag. The Emily Post Institute says that as long as you ask politely, the guardian probably will not mind at all.

Ask the guardian to keep the dog leashed outside (weather permitting). As with all things, it's your house, your rules. If the dog is barking too much or for too long, then perhaps it's best to move the get-together to a neutral setting outside of your home.

Remember that if it's your furniture, it's your call. This sectional probably looks like a big, inviting marshmallow bed to a dog. It's up to you to let the dog's guardian know if you're not comfortable with having dogs on the furniture or rugs. Although pet hairs would lift off easily from the cowhide rug in the picture above, dog urine stains are an entirely different issue. It’s a somewhat ironic situation, since I’m an exceedingly dog-friendly landlord myself (I prefer renting to folks with dogs!) in the two rental spaces I've carved out of the restored Victorian we call home.

I’m not alone in having trouble with this search. Some 72% of residents say that pet-friendly housing is hard to find, according to Jam Stewart, vice president of corporate affairs for Mars Petcare North America, which offers a guide on 8 Tips to Be Successful When Renting With Pets.

The house rules in our multi-unit development complex do not allow the presence of dogs and there are notices in common areas to this effect. Unfortunately, the dog numbers and indeed their sizes are increasing.

Their prevalence is blamed on landlords who at the time of letting, do not specify the “no dogs allowed” rule and it is then too late as it were to lock the kennel door.

Owner-occupiers are concerned about getting bitten – or worse, witness the terrible tragedy in Galway recently – as well as the potential health dangers through the transmission of toxocariasis from dog poo. The local villages have warning signs about this.

I would like to know:

Is there anything that can be done retroactively – fines are imposed for other breaches of the house rules.

What are the consequences for the complex/landlord if someone is bitten? (Health issues would be difficult to prove.)

What is a reasonable voting threshold to secure all house rules? A simple majority with a low turnout is a concern.

In most apartment complexes pets will either be prohibited entirely or only permitted on the proviso that they do not become a nuisance. Every letting within the complex is subject to the observance of these rules.

You mention that the house rules do not allow dogs and that there is already a system of fines for house rule breaches. In this instance the owners’ management company (OMC) is within its rights to seek the removal of any dog (or pet) within the complex and to impose a fine upon the apartment owner for the breach of the rules. You should contact the OMC (or its agent) to raise your concerns.all related materials and equipment within 24 hours. If UMSL must remove the pet, the Student will be responsible for all related charges. Sample 1 Sample 2 Save Copy NO PETS. No pets are allowed on the premises at any time, including pets of guests. Any violation of this rule shall result in the sum of $500 due and payable to the Landlord by the Tenant. There are smoke detectors at all levels of the house/premises. Tenants are responsible for the yard, sidewalk, and garbage if renting a house, and must pay all tickets from the failure to perform responsibly and according to law. Furnace filters must be changed periodically for better performance, and to save on energy costs. IF the rent is not received by the fifth (5th) of the month, a late charge of 10% (ten percent) of one month’s rent must also be paid. On the tenth (10th), an eviction notice may be given. Sublets are allowed ONLY with the approval of all roommates on the lease. Tenant(s): (signed) Sample 1 Save Copy NO PETS. If pet(s) or evidence of pet(s) are found at the property without prior approval by MBS, you will be asked to vacate immediately and forfeit all rental payments. Any evidence of pets in your rental property or on the premises may also result in additional charges. Sample 1 Save Copy NO PETS. No smoking inside the house. Pets or smoking inside the property will result in immediate termination of occupancy and forfeiture of all payments. Candles may not be used in the house except in the rare case of a prolonged power failure.
