Javni poziv k prenehanju kolektivnih izgonov na južni meji
Po objavi poročila skupine Info Kolpa o nezakonitih kolektivnih izgonih na slovensko-hrvaški meji
V zadnjem letu se vrstijo dokazi in pričevanja, ki vse bolj nedvoumno potrjujejo, da slovenska policija pri ravnanju z migranti ne spoštuje zakonodaje, ustavne ureditve in mednarodnopravnih zavez. Spodaj podpisane organizacije, posameznice in posamezniki zato zahtevamo ukrepanje pristojnih organov in prevzem politične odgovornosti.
Maja lani je na Policijski postaji Črnomelj 98 odstotkov oseb, obravnavanih zaradi domnevno nelegalnega prehoda meje, izrazilo namero zaprositi za azil. Naslednji mesec je ta delež upadel na le 3 odstotke. Drastičen upad je bil zaznan tudi na PP Metlika, PP Ilirska Bistrica in PP Dragonja. Ta nenaden in nepojasnjen upad deleža prošenj za azil časovno sovpada z izdajo navodil, ki jih je izdalo vodstvo policije in ki naj bi jih upoštevale policijske postaje pri obravnavi migrantov. Policija se proti razkritju teh navodil kljub odločbi informacijske pooblaščenke, da gre za informacijo javnega značaja, bori na sodišču. Malo verjetno je, da gre za naključje, okoliščine pa močno nakazujejo, da je policija začela prosilce za azil na nelegalen način zavračati in jih izročati hrvaškim varnostnim organom.
Tudi Varuh človekovih pravic RS je v vmesnem in končnem poročilu o obiskih policijskih postaj Črnomelj, Metlika in Ilirska Bistrica “opozoril na pomanjkljivo obravnavo osebnih okoliščin vsakega posameznika na način, ki bi lahko odpravil dvom, ali je imela oseba, ki je bila pridržana na policijski postaji, namero podati prošnjo za mednarodno zaščito oziroma ali jo je podala, pa je bila ta morda preslišana.” Kljub temu se Varuh ni hotel jasno opredeliti do legalnosti policijskih postopkov. Dvomi glede dostopnosti pravice do azila, ki je človekova pravica, so nedopustni.
V zadnjem letu so medijska poročila (1, 2, 3) ter poročila organizacij Amnesty International in PIC zabeležila številna pričevanja migrantov, da slovenska policija izražene namere zaprositi za azil ni upoštevala in jih je po plačilu globe zaradi nelegalnega prehoda meje večkrat vrnila na Hrvaško, hrvaška policija pa jih je nadalje nasilno vrnila v Bosno in Hercegovino.
Nenazadnje je ta medijska poročila nedvoumno potrdilo in nadgradilo še poročilo skupine Info Kolpa. Navajajo več primerov, podprtih z dokumentacijo, v katerih so migranti jasno izrazili namero zaprositi za azil in sami zaprosili za kontakt s policijo, a jih je policija kljub temu vrnila na Hrvaško, navkljub temu da je bil o njihovi prisotnosti v Sloveniji vsakič nemudoma obveščen tudi Varuh človekovih pravic!
Vračanje na Hrvaško slovenska policija izvaja po hitrem postopku pod pretvezo medvladnega sporazuma. Hrvaška policija nato migrante sistematično pretepa, jim razbija telefone in jih okrade, kar je ugotovil tudi hrvaški varuh človekovih pravic.
Prav nezakonito omejevanje migracij s strani policije vodi v incidente, kot se je zgodil v Beli krajini pretekli teden, ko se ljudje zaradi strahu pred ravnanjem policije zatečejo k obupanim poskusom preživetja. Krivi niso udeleženi posamezniki, temveč nasilno in nezakonito ravnanje državne oblasti. Migracije so rezultat globalnih procesov, njihova legalizacija pa je edina možnost za prihodnost.
Kombinacija dokazov - statističnih, opozoril varuha, medijskih pričevanj in dokumentiranih primerov nezakonitega vračanja - napeljuje na zaključek, da slovenska policija protipravno odreka pravico do azila. Tovrstne prakse, v kateri o dostopu do azilnega postopka odločajo policisti na meji, ne gre jemati zlahka, saj gre za kršitev človekovih pravic in načela pravne države, kar je treba jasno obsoditi in se proti temu vztrajno boriti.
Upoštevajoč, da je dostop do azila človekova pravica, zahtevamo:

od vlade odstop od meddržavnega Sporazuma med vlado Republike Slovenije in vlado Republike Hrvaške o izročitvi in sprejemu oseb, katerih vstop ali prebivanje je nezakonito;

od varuha človekovih pravic Petra Svetine jasno opredelitev do policijskih postopkov z migranti na meji na podlagi informacij, pridobljenih v okviru obiskov policijskih postaj, in drugih informacij;
-
od varuha človekovih pravic Petra Svetine uvedbo nepristranske preiskave obravnave migrantov in onemogočanja dostopa do azila ter javno objavo izsledkov;

od ministra za notranje zadeve Boštjana Poklukarja, da se podrobno opredeli do poročila skupine Info Kolpa, zlasti do izpostavljenih konkretnih primerov protipravnega vračanja migrantov na Hrvaško kljub izraženi nameri o zaprositvi za azil v Sloveniji;

od ministra za notranje zadeve Boštjana Poklukarja, da dopusti prisotnost civilne družbe v postopkih obravnave migrantov z namenom vzpostavitve civilnega nadzora nad postopki, za katere obstaja upravičen sum kršenja najbolj temeljnih človekovih pravic;

od ministra za notranje zadeve Boštjana Poklukarja, da pojasni nenaden upad deleža izraženih namer za zaprositev za azil med majem in junijem 2018.
Public demand to end the collective expulsions on the southern border
In the last year, evidence and testimonies confirm without doubt that Slovene police does not respect national legislation, constitutional arrangements and international law when dealing with migrants on the border. The undersigned organizations and individuals are therefore are demanding proper action from competent authorities responsible for the respect of human rights and the assumption of responsibility from those who abuse power in procedures concerning migrants.
In May last year, at the Črnomelj Police Station, 98 percent of people were processed for illegal border crossing, expressed the intention to seek asylum in Slovenia. The next month the percentage of people who expressed the intention to seek asylum fell to only 3 percent. Drastic decline was also detected at PS Metlika, PS Ilirska Bistrica and PS Dragonja. This sudden and unexplained decline in the share of asylum applications coincides with the issue of police instructions from top police commanders which instruct how police officers should act when dealing with migrants on the border. The Slovenian Police is fighting against the disclosure of these instructions on the court despite the decision of the information commissioner, that this documents are of a public nature and should be published without censorship. It's unlikely that this is only coincidence, and the circumstances strongly suggest that the police officer on border have begun to pushback asylum seekers and hand them over to the Croatian security authorities after command from the top officials was issued in the end of May last year.
The Human Rights Ombudsman of the Republic of Slovenia has in his report on visits to police stations Črnomelj, Metlika and Ilirska Bistrica pointed out “the inadequate treatment of personal circumstances of each individual in a way that could dispel the doubts whether the person who was in detention in police station had the intention of applying for asylum, or whether she or he expressed their request to seek asylum but was ignored." Nevertheless, the Ombudsman did not want to make any statement about the legality of police procedures. Doubts regarding the accessibility of the right to asylum, which is a human right, cannot be tolerated.
In the last year, both journalists and organizations such as Amnesty International Slovenia and Pravno-informacijiski center - PIC recorded numerous testimonies of migrants, whose request to seek asylum in Slovenia was illegally rejected by police and were not accepted to official procedures. Many were instead forced to pay a fine for illegal border crossing and were expelled to Croatia and from there to Bosnia and Herzegovina.
Already existing reports are undoubtedly confirmed and updated by the Info Kolpa report. The report cites several cases in which migrants clearly expressed their intention to seek asylum in Slovenia to police officers and their wish to seek asylum was also communicated through a third party but were nevertheless returned to Croatia even though the Ombudsman was informed of their presence in Slovenia and intention to seek asylum.
The Slovenian police are conducting collective expulsion to Croatia under the pretext of the bilateral agreement on readmission. It has been recorded that Croatian police are systematically beating the migrants, destroying their phones and stealing money. All this violent action have already been confirmed by Croatian Ombudsman and UNHCR.
Violent and illegal restriction of migration leads to incidents, such as the one in Bela Krajina when people are forced to turn to desperate actions in fear of police violence in their attempts to survive and start a normal life. The guilty are not the individuals, but violent in unlawful conduct of state authorities. Migration is result of global processes and legalization of migration is the only possibility for future.
The combination of evidence - statistical, ombudsman reports, media report and documented testimonies of illegal returns - lead to the conclusion that the Slovenian police has illegally denied the right to asylum procedure in the last year to tat least 4500 who have crossed the border. These practices of denying access to the asylum by police officers at the border cannot be taken lightly, as they constitute a violation of fundamental human rights and right to due process. These illegal actions of state authorities have to be clearly condemned and persistently fought against.
Considering that access to asylum is a human right, we demand:
- From the Government of Slovenia to withdraw from the bilateral agreement on the extradition and admission of persons whose entry or residence is illegal between the Government of the Republic of Slovenia and the Government of the Republic of Croatia
- from the Human Rights Ombudsman Petra Svetina a clear statement on legality on police procedures with migrants on the border considering the information obtained in the course of police station visits and other information;
- from the Human Rights Ombudsman Peter Svetina to start an impartial investigation of the police procedures with migrants about accusations on denying access to asylum procedure and publication of the results;
- from Boštjan Poklukar, Minister of the Interior, to declare himself on the legality or illegality of the expulsion of migrants to Croatia who expressed intention to apply for asylum in Slovenia but were rejected as it is documented in the Info Kolpa report;
- from Boštjan Poklukar, Minister of the Interior, to allow the presence of civil society in the procedures concerning migrants with the purpose to establish a civilian control over the procedures for which there is a justified suspicion of violation of the most fundamental human rights;
- from Boštjan Poklukar, Minister of the Interior, to explain the sudden decline in the share ofexpressed intentions to seek for asylum between May and June 2018.
